Path blocked by Fudstone resident

by Irvin Clifford
  • Path entrance

A number of Fudstone based dog walkers and countryside walkers have been shocked to discover that the access to the path from Newhouse Drive, through the fields leading up around the Puddocks pond and onto the rear of the old mink farm, has been blocked off by the resident of the house immediately adjacent to the public paths entrance way.

The path has been in existence for over two and a half years and it has been in the past month that this has happened, as has been pointed out by some of the path users this is a public foot path with full public access on privately owned ground.

NAC planning department has been contacted over this issue and have stated that they will investigate the matter.

Going by the picture and the plans available online it looks like the resident has only fenced off his own garden, so surely the problem is with the owner of the metal fence.

Norman Murray says

It may be the case that the fence has been legitimately erected by the resident in accordance with the boundary as described in his/her title deeds.

If that's the case Steven why didn't the house owner complain or stop the gate being put up on his land? I think it is terrible that a walkway that is used by a lot of people myself included can just be blocked off! A lot of elderly people use the walkway and youngsters, now they have to climb through a gate to get access. Surely the council can arrange to move the metal fence and erect a new gate! After all there is an election coming up mybe win them some mutch needed votes?

Hey guys, the point I was making in the post is that the entrance way and gate to the path has been in use and existence for over 2 and a half years and the resident of the property made no efforts to block the path, now suddenly it is blocked, why did the resident not either complain or do something about the gate being installed at the time of construction after all it took 6 weeks to build the path, plenty time to raise any objections.
As for the metal fence that belongs to NAC.

Why don't they just take the padlock off the gate that is beside the fence. I walk my dogs there as well and I just climb over no problem.

hey irvin clifford if you could be bothered to ask me you would find that i have been trying to get this sorted since they started working on this site and going by the plans that i have there is plenty still to be done when i find the plans i will display a copy on the fence if anybody has a problem with this take it up with the forrestry commission or the land owner the council have no power on this matter i have tried

I live at the bottom of Newhouse Drive and walk my dog on the path daily and have done since the new path was built. I know that the resident has continually tried to get this sorted out from the time it was done to no avail. When the path is finished (according to plans) the entrance will be 25metres along the high steel fence from the garden in question. I wonder who was paid to build this path as it seems to me that they have walked away with a load of money for works that were never carried out. Instead of bitching about a man reclaiming what belongs to him try moaning at the land owner or the forrestry commision and get it sorted.
